1.      Introduction

 

LG Electronics Inc. (“LGE” or “we”) is committed to protecting the information of those individuals and groups who access and use one or more web-monitoring supported LG Solar Panels (“Panel” or “Panels”), LG Solar Panel websites, including http://enervu.lg-solar.com and any other website on which this Privacy Policy is made available (“Websites”), and variety of services that are provided through the Websites, such as web-based monitoring services and other interactive features that we may make available from time to time           (together with the Websites, the “Services”).

 

This Privacy Policy sets out how we collect, use, and share information that we obtain as a result of your use of these Services and, in particular, describes:

 

·         What information LGE may obtain from you, your installer/distributor, or your Solar Panel and inverters;

·         How LGE uses the information that it obtains;

·         When LGE shares information with others; and

·         How you may control LGE’s use and sharing of your information.

 

Depending on the country where you are based and the model of Panel that you own, the Services may include features such as web monitoring services, graphic tools, advertisements, and weather information; however, some of the features may have different names and may be combined with other features. LGE reserves the right to add or remove services from its Websites and to modify its Services from time to time.

 

LGE’s Services may provide access to websites and links to other services owned and operated by third parties. These third party services are outside the scope of this Privacy Policy and have their own policies that apply to the collection, use, and sharing of information in connection with their services. We encourage you to read those policies. LGE is not responsible or liable for the privacy practices of such third parties.

 

The Services are offered to LGE Account holders. Your use of the Services is therefore subject to the LG Account Privacy Policy located at www.lgaccount.com. However, to the extent that there are any inconsistencies between the LG Account Privacy Policy and this Privacy Policy (whether as a result of the use of inconsistent terminology or otherwise), this Privacy Policy will prevail as regards your use of the Services. 

 

2.      What information does LGE collect?

 

There are varieties of ways that we may collect information from you; the below lists some of ways we may collect such information:

 

·          Information provided upon your registration on our Websites

 

We collect information when you register with us. When you register, we ask for you to provide us with information such as Account Information (capitalized terms are described further below).

 

·          Information received directly from the Panel

 

When your Panel is connected to the Internet, during the set-up process and thereafter, we will receive certain information, including Device Information or Power Generated Information, that is needed to authenticate and set up your Panel, as well as to power  the web-monitoring services. This information is necessary for the basic functioning of the web-monitoring services.

 

·          Information directly received via your installers/distributor

 

We receive your email address from your installer/distributor so that we may notify you of your ability to register for web-monitoring services. If you choose to create an account and register for the web-monitoring services, your installer/distributor will provide us with your name, address, and telephone number from your installer/distributor. After your installer/distributor has finalized installation of the Solar Panel, we will receive certain information, including the precise location of where your Panel is installed, array information, Device Information of each inverter or gateway, and Installation Information from your installer/distributor. Other than your email address, we will store, but will not process, information that is directly provided by your installer/distributor until you have fully registered as an LG Account holder on the Websites. This information is necessary for the basic functioning of the Services.

 

The information that we may receive when you use the Services falls into the following categories:

 

·         Device Information. We automatically collect information about your Panel and certain related devices such as your inverters and gateways that you use with the Services. Device Information may include information to authenticate your Panel with our servers such as your IP Address or MAC address.

·         Account Information. When you first register with the Services, you will be asked and prompted to enter certain information, such as your email address (which will be your user ID), password, telephone number, name, and address. If you register using your Facebook credentials, you authorize us to collect your Facebook email ID. 

·         Power Generated Information. Power Generated Information refers to all information collected by Panel, inverters or gateways such as how much electricity your Panel has generated. In addition, it refers to all information presented to you through the Website.

·         Installation Information. Installers/Distributors may from time to time provide us with information about your Panel such as a precise location of your Panel, array information, inverter and gateway information.

·         Log Files/IP Address. When you visit the Websites, we may automatically log your IP address (the unique address which identifies your computer on the internet) which is automatically recognized by our server.

 

Device Information or Power Generated Information are generally handled by LGE in such a way that members of your household are not identified or identifiable from that information, so such information is not “personal information.” If you become a member of Websites and use the Services, however, then certain Device Information or Power Generated Information may become personally identifiable to you

 

3.      How will LGE use the information it obtains?

 

We use information obtained from your Panel and Websites (both non-personal information and, where applicable, personal information) for various purposes, including:

 

·         to provide our Services;

·         to analyze, review and improve the products and services we offer;

·         to understand how customers are using Panel and Websites;

·         to develop new products and services;

·         to provide you with a user-friendly navigation experience;

·         to protect and defend our rights and property, including by way of legal proceedings;

·         to comply with regulatory requirements;

·         to collect payment for content you purchase;

·         to send you transactional communication and materials about LGE Services;

·         for marketing; and

·         for internal record keeping.

 

We may combine information obtained from the Services, including personal information, with information that you provide to us by other means for the above purposes.

 

4.      Information Sharing

 

We may share your information, including personal information, with third parties in the following circumstances:

 

·         To provide our Services;

·         For installers/distributors to provide their services to you;

·         As required by court order or other government or law enforcement authorities in order to comply with legal process or law;

·         In connection with a corporate event, such as a merger or sale of all or part of LGE’s business (including that of a division or subsidiary), where LGE may need to disclose information to a potential buyer and its professional advisers;

·         In order to protect and defend our rights and property, including by way of legal proceedings;

·         In order to protect the personal safety or property of our users or the public; and

·         In order to protect your interests or comply with regulatory requirements (for example, if you or your installer/distributor has applied for a solar rebate or incentive (“Rebate”), we may provide certain information to relevant regulatory bodies, utilities or program administrators.

 

Please note that regulatory bodies, utilities or program administrators may further disclose or publish certain data relating to your Panel. LGE is not obligated to apply for Rebates on your behalf, and disclaims all liability for your or your installer’s failure to obtain a Rebate. LG does not make any representations regarding the availability of Rebates.

 

LGE may also share personal information and non-personal information with its affiliates and subsidiaries around the world for the purposes described in this Privacy Policy.

 

5.      Overseas Transfers

 

We, our affiliates, subsidiaries, and suppliers may use information (including your personal information) in countries other than where your Panel is located in connection with providing you with our Services and any other purposes outlined in this Privacy Policy. The data protection laws in many of these countries may not offer the same level of protection as those in the country where you are located. However, before transferring your personal information we will take steps to ensure that such information will be afforded the same level of protection. By agreeing to this Privacy Policy you expressly consent to us and our business associates and suppliers processing your data in any jurisdiction, including, without limitation, Republic of Korea in accordance with this Privacy Policy.

 

6.      How long will LGE keep my personal information?

 

We will keep your personal information for as long as is necessary for us to provide you with Services or other purposes set out in this Privacy Policy.

 

7.      Security

 

We use commercially reasonable efforts to safeguard the confidentiality of your personal information. Nevertheless, due to the design of the Internet, ever-changing technology, and other factors outside of our control, we cannot guarantee that communications between you, your Panel, and our servers will be free from unauthorized access by third parties or that we will not be subject to security breaches. We do not accept any responsibility for the disclosure of personal information due to errors in transmission or unauthorized or unlawful acts of third parties.

 

8.      Protecting the Privacy of Children

 

Protecting the privacy of children is important to us. For that reason, none of our Services are directed at or designed to attract anyone under 13 years old. We also do not knowingly collect or maintain personal information from users who are under 13 years old. Should we learn or be notified that we have collected information from users under the age of 13, we will promptly delete such personal information.

 

9.      Changes to LGE's Privacy Policy

 

This Privacy Policy may be updated by LGE from time to time. If we make a material change to our Privacy Policy, we will update you via Websites, Services or other means. If you do not consent to the updated privacy policy, some Services may be restricted.

11.  Accessing and Modifying Your Information, and Your Choices Regarding Your Information

 

You can access and modify some of the personal information you provided to us by logging into your account and changing the information that you previously provided.

 

From time to time, we communicate with users who use the Services through email.

 

For example, we may use your email address to confirm receipt of your request, to send you information about changes to our services, and to send you notices and other disclosures as required by law. Generally, you cannot opt out of these service-related communications. However, you may opt out of receiving promotional emails from LGE by following the instructions in these emails.  We will process your requests to unsubscribe from promotional communications as soon as possible, but please be aware that in some circumstances you may receive a few more messages until the unsubscribe request is processed.
